Even in the case where a person is at the origin of her injury by an animal, the breeder will also be considered like person responsible, according to a project of law on the offenses submitted to the exam of the supreme legislative body of China.
The project of law, that aims to reinforce the protection of the civil laws, has been submitted Monday in second reading to the Standing Committee of the 11st National Popular Assembly (APN).
According to the new project of law, the breeders of animals will assume more responsibility than in the existing regulations.
So the breeder will be considered responsible if his house pet wounds others, however, if the master of the animal is able to prove that the incident has been provoked by a "serious offense" on behalf of the injured, it will be able to benefit from a reduction or an exemption of his responsibility.
Some legislators called to remove the clause on the exemption of the breeder’s responsibility. "Whatever is the serious offense led by the injured, the breeder must assume responsibility to a certain level," affirmed Cao Bochun, member of the Standing Committee of the 11st APN.
Bites by animals became a non-negligible problem in China these last years. For a long time, rabies appears among the three illnesses among the most murderous infectious illnesses in China.
